Legal Fees
The cost of many legal services has not significantly increased for several years. But, yes, there can be significant cost involved, depending upon the complexity of the matter and the responsibility assumed by the lawyer. Remember, you are not paying for just legal paper when you engage a lawyer – but rather for the skills, expertise, experience and determination brought to bear on your problem, the assurance that your transaction will proceed as smoothly as possible and that you will get what you bargained for; and finally, for the legal support staff and facilities that allows your lawyer to be available when needed and to provide prompt, efficient service.
Since lawyers sell their time, their knowledge, and their practical skills, the common perception is that whenever you go near a lawyer’s office, you. This is not surprising (and not entirely untrue) However, you the client can help keep the cost to a minimum.
When you make your appointment, it greatly assists your lawyer if you have typed or written a summary of the facts relevant to your problem. Bring any documents with you as well that relate to your concerns, preferably prepared chronologically. A well-organised client can assist a lawyer immeasurably in getting to the heart of the problem, and as such, can assist in keeping legal costs to a minimum.
A few pointers respecting fees:
- A lawyer can usually give you a ballpark estimate of fees respecting most residential real estate transactions. Commercial real estate, corporate and business transactions are more complex and require greater time commitments. Litigation is another matter, since the fees will vary greatly, depending on the state at which the case is settled or the length of trial if the matter proceeds to Court. Discuss these matters in advance with your lawyer;
- Motor vehicle litigation and certain personal injury claims may be handled on a contingency basis, subject to the client’s approval;
- Be concerned with the quality and promptness of service. Time means money in our fast paced society. Some clients spend literally hundreds of frustrating hours trying to perform functions better left to a lawyer or accountant – all for the sake of saving a relatively small amount in professional fees;
- When the requirements of a case change, it is only natural the cost will too. Surprises come from many directions. Negotiating anything is expensive and problematic, as you cannot force the other side to make a deal, even when it appears to make sense for both sides.
